HomeMy WebLinkAbout91_011 PC ResolutionRESOLUTION NO. 91-011 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMECULA REGARDING VACATION OF A STORM DRAIN, DRAINAGE FLOWAGE, AND ROAD EASEMENTS. WHEREAS, the City is presently the owner of a storm drain, drainage flowage, and road easements located within the Tentative Vesting Tract Map No. 23371 (hereinafter, the "Easement"). The Easement is more particularly described in Exhibit A, which is attached hereto and incorporated herein by this reference; WHEREAS, Margarita Village Development Company has petitioned that the City vacate the Easement; and WHEREAS, before the City may vacate this easement, it must be determined whether the vacation is consistent with the General Plan the City is presently developing, pursuant to Government Code Section 65360; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF TEMECULA DOES HEREBY FINDS, RESOLVES, AND DETERMINES AS FOLLOWS: Section 1. There is reasonable probability that vacation of the Easement will be consistent with the General Plan the City is presently developing. Section 2. There is no likelihood of substantial detriment to or interference with the City's future General Plan if vacating the Easement ultimately is inconsistent with the Plan. Section 3. The vacation of the Easement complies with all other applicable requirements of State Law and City Ordinances. Section 4. Resolution. The Secretary to the Commission shall certify the adoption of the Section 5. The Planning Commission of the City of Temecula, does hereby recommend that the City Council adopt a resolution vacating storm drain, drainage flow, and road easements in conformance with Exhibit A.
