HomeMy WebLinkAbout95_008 PC ResolutionPC RESOLUTION NO. 95-008 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMECULA RECOMMENDING THAT THE CITY COUNCIL NOT · CERTIFY THE FINAL ENVIRONMENTAL IMPACT REPORT (PA93-0180) ALONG WITH ITS SUBSEQUENT ADDENDUM, DENYING FINDINGS OF FACT AND STATEMENTS OF OVERRIDING CONSIDERATION AND DENYING THE MITIGATION MONITORING PROGRAM ON PROPERTY LOCATED ON THE NORTHEAST CORNER OF THE FUTURE INTERSECTION OF BUTTERFIELD STAGE ROAD AND MURRIF~TA HOT SPRINGS ROAD AND KNOWN AS ASSESSOR'S PARCEL NO. 914- 210-047, 914-210-051, 914-240-001, 914-240-003, 914-240-004 AND 914-320- 003. WHEREAS, Douglas Wood and Associates completed Final Environmental Impact Report (PA93-0180) under City's direction and in accordance with the provisions of the City and the California Environmental Quality Act (CEQA) Guidelines; WHEREAS, said EIR application was processed in the time and manner prescribed by State and local law; WHEREAS, the Planning Commission considered said Final Environmental Impact Report (FEIR) which includes the Draft EIR, the Addendum, the Technical Appendices, the Response to Comments, the Mitigation Monitoring Program, Findings of Fact and Statements of Overriding Considerations on April 17, 1995, at which time interested persons had an opportunity to testify either in support or opposition; and WHEREAS, at the conclusion of the Planning Commission hearing, the Planning Commission recommended that the FEIR not be certified and that the Findings of Fact and Statements of Overriding Consideration and the Mitigation Monitoring Program be denied. NOW, THEREFORE, THE CITY OF TEMECULA PLANNING COMMISSION DOES RF~OLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. F_JlgJJg~ That the City of Temecula Planning Commission in recommending that the FEIR not be certified, makes the following findings, to wit: 1. The mitigation measures of the project do not adequately mitigate the impacts of the project. 2. The benefits of the project does not outweigh the project's unmitigated significant environmental impacts. Section 2. ~ That the City of Temecula Planning Commission hereby recommends that the City Council not certify the FEIR (PA93-0180), and deny the Findings of Fact and Statements of Overriding Consideration and the Mitigation Monitoring Program for the Johnson Ranch Specific Plan, Annexation, General Plan Amendment, Development Agreement, and Change of Zone on property located on the northeast coreer of the future intersection of Butterfield Stage Road and Murrieta Hot Springs Road and known as Assessor's Parcel No. 914- 210-047, 914-210-051,914-240-001,914-240-003,914-240-004 and 914-320-003. Section 3. PASSED, APPROVED AND ADO~/~D this 17th day of April, 1995. I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Planning Commission of the City of Temecula at a regular meeting thereof, held on the 17th day of April, 1996 by the following vote of the Commission: AYES: 3 PLANNING COMMISSIONERS: FAHEY, SLAVEN, FORD NOES: 1 PLANNING COMMISSIONERS: WEBSTER ABSENT: 1 PLANNING COMMISSIONERS: BLAIR SECRETARY
