HomeMy WebLinkAbout95_002 PC ResolutionATTACHMENT NO. 1 RESOLUTION NO. 95-002 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMECULA APPROVING PUBLIC USE PERMIT NO. 6, AMENDMENT NO. 6 TO PERMIT OPERATION OF A 5,040 SQUARE FOOT CHURCH AND 4,320 SQUARE FEET OF CLASSROOMS LOCATED ON THE SOUTHEAST ICORNER OF CALLE GIRASOL AND TOMMY LANE AND KNOWN AS ASSESSOR'S PARCEL NO. 914-500-004 WHEREAS, The Church of Christ filed Public Use Permit No. 6 in accordance with the City of Temecula General Plan and] Riverside County Land Use and Subdivision Ordinances, which the City has adopted by reference; / WHEREAS, Public Use Perlmit No. 6 was processed in the time and manner prescribed by State and local law; WHEREAS, the Planning Commission considered Public Use Permit No. 6, Amendment No. 5 on May 2, 1994, at a duly nCticed public hearing as prescribed by law, at which time interested persons had an opportunity to testify either in support or in opposition WHEREAS, at the public hearing, upon hearing and considering all testimony and arguments, if any, of all persons deserwng to be heard, the Commission considered all facts relating to Public Use Permit No. 6! Amendment No. 5; / WHEREAS, the Planning C Iommission continued Public Use Permit No. 6, Amendment No. 5 on May 2, 1994, off-calendar, to be re-noticed upon its return before the Planning CommiWHEREAS,.,sion; the Planning Commission considered Public Use Permit No. 6, Amendment No. 6 on January 23, 1995, at a dul3 noticed public hearing as prescribed by law, at which time interested persons had an opportunily to testify either in support or in opposition; WHEREAS, at the public hearing, upon hearing and considering all testimony and arguments, ~f any, of all persons deserving to be heard, the Commission considered all facts relating to Public Use Permit No. 6!, Amendment No. 6; NOW, THEREFORE, TI~E PLANNING COMMISSION OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above ?ecitations are true and correct. R:\STAFFRPT\6PUP.PC2 1/9/96 klb 9 Section 2. Findings. That the Temecula Planning Commission hereby makes the following findings:. 1. The land use or actio proposed is consistent with the General Plan. The land use designation for the site is identified in the General Plan as Very Low Density Residential (.2 - .4 dwelling units per acre maximum). The General Plan states: "Additional public and institutional uses, ~ncludmg churches and daycare fac~ht~es, may be developed in the residential land use designations under the procedures established in the Development Code." Until the Code is adopted, the Iprovisions contained in Ordinance No. 348 are utilized. Development Churches are permitted in any zone Onder Ordinance No. 348 provided that a public use permit is granted. 2. The proposed use or action complies with all other requirements of state law and local ordinances. The proposed use complies with California Governmental Code Section 65360, Section 18.29 (Public Use P~rmit) of Ordinance No. 348. 3. The proposed project, will not be detrimental to the health, safety or general welfare of the community. In addition, the proposed project will not have a significant impact on the environment. M~t~gat~on measures have been included in the Conditions of Approval that will reduce any impacts to a level ldss than significant. 4. The site is suitable to shape of the lot configuration, acc application (Public Use Permit), as the City's General Plan and Ordin: iccommodate the proposed land use in terms of the size and :ss, and intensity of use, because the proposed planning conditioned, complies with the standards contained within tce No. 348. 5. The project has acceptable access to a dedicated right-of-way which is open to, and useable by, vehicular traffic. ~ccess to the project site is from a publicly maintained road (Calle Girasol). 6. The design of the project and the type of improvements are such that they are not in conflict with easements for accessI through or use of the property within the proposed project. 7. Said findings are su]pported by maps, exhibits and environmental documents associated with these applications arid herein incorporated by reference. A. As conditione~d pursuant to Section 4, Public Use Permit bio. 6, Amendment No. 6, as proposed, is compatible with the health, safety and welfare of the community. Section 3. Environmental Compliance. An Initial Study prepared for this project indicates that although the proposed ~lproject could have a significant impact on the environment, there will not be a significant effec! in this case because the mitigation measures described in the Conditions of Approval have been added to the project, and a Negative Declaration, therefore, is hereby granted. That the City of Temecula Planning Commission hereby approves Public Use Permit No. 6, Amendment No. 6 for the operation and construction of a church and classrooms in two (2) pleases. The first phase will consist of a 3,600 square foot Church/Assembly Building and tw~ (2) 1 440 Classroom Buildings, totalling approximately 6,480 square feet. The second ~phase will be a 1,440 square foot expansion to the Church/Assembly Building and theladdition of 1,440 square feet of classroom area. Total square footage at buildout is 9,360, located at the southeast corner of Calle Girasol and Tommy Lane and known as Assessor s Parcel No. 914-500-004, subject to the following conditions: / 1.
