HomeMy WebLinkAbout041596 PC MinutesMINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA PLANNING COMMISSION APRIL 15, 1996 A regular meeting of the City of the Temecula Planning Commission was called to order on Monday, April 15, 1996, 6:00 P.M., at the Rancho California Water District Board Room, 42135 Winchester Road, Temecula, California. Chairperson Fahey presiding. PRESENT: Miller, Slaven, Soltysiak, Webster, Fahey ABSENT: None Also present were Planning Manager Debbie Ubnoske, Assistant City Attorney Greg Diaz, Senior Planner John Meyer, and Principal Engineer Steve Cresswell. PUBLIC COMMENTS Chairperson Fahey called for public comments on non-agenda items at 6:05 P.M. There were no requests to speak. COMMISSION BUSINESS 1. Approval of Agenda It was moved by Commissioner Slaven and seconded by Commissioner Webster to approve the agenda. The motion carried as follows: AYES: 5 COMMISSIONERS: Miller, Slaven, Fahey, Webster, Soltysiak NOES: 0 COMMISSIONERS: None ABSENT: 0 COMMISSIONERS: None 2. Beer and Wine License for PA96-0048 CUP for Texaco Senior Planner John Meyer presented the staff report and requested the Commission determine if the State ordinance allows a finding of either public convenience or necessity to allow beer and wine sales at the Texaco station. Commissioner Slaven expressed opposition to for allowing beer and wine sales at another gas station. She expressed her concern with finding rationale for convenience or necessity and felt there was undue concentration of this type of use in the area. Chairperson Fahey expressed surprise that the applicant was not in attendance. She requested the Commission delay the discussion to give the applicant time to arrive. The Commission agreed by unanimous consensus to delay this matter pending arrival of the proponent. Minutes.pc.04/15/96 PLANNING COMMISSION APRIL 15, 1996 3. Fast Track System Planning Manager Debbie Ubnoske presented the staff report and requested input and comments from the Commissioners. Commissioner Soltysiak expressed appreciation for staff's effort in putting the document together. He expressed confusion on several title definitions in the flow chart and stated that consistency was missing. His primary concern is the timeline for pulling building permits prior to pulling grading permits. He also recommended the DRC be moved up. Principle Engineer Steve Cresswell responded that at the first meeting with the applicant they are asked when they want to pull the grading permit. Commissioner Soltysiak asked if staff individualized each project and if traffic and other studies were required for fast-track projects. Planning Manager Debbie Ubonske responded that most projects are in urban areas where technical studies have been conducted on other projects within the same area, 4. Development Review Filing Schedule Senior Planner John Meyer reported that staff was formalizing the manner in which projects are processed to the Planning Commission. The fast-track is handled on a 9 week schedule with a two week turn around from DRC to the final submittal. The result is more information comes before the Commission which is expected to facilitate the process. Chairperson Fahey requested a fast track schedule be provided to the Commission. Senior Planner Meyer responded this would be provided in the future. Chairperson Fahey recommended that the titles be changed to Formal Submittal or Final Submittal deleting Initial Submittal. Senior Planner Meyer responded this is possible. The Commission expressed support for the concept of the Development Review Filing Schedule. 2. Beer and Wine License for PA96-0048 CUP for Texaco Rich Tate, Tate and Associates, representative for Texaco Service Company, spoke to request the Commission allow Texaco to sell beer and wine at the Food Mart. He informed the Commission that employees are trained on how to sell beer and wine correctly and Texaco has agreed to all prior conditions the Commission had requested. Commissioner Fahey requested the previous conditions be reviewed. Rich Tate reviewed the previous conditions, which included the following: Minutes .pc, 04/15/96 PLANNING COMMISSION APRIL 15, 1996 Beer and wine sales or displays will not be located at or near the cash register. Beer and wine advertisements will not be displayed in the aisles. · Ice tubs filled with beer will not be used. · Alcohol sales will not be permitted through the drive-thru. Coin operated amusement devices will not be permitted so loitering will not be encouraged. Beer and wine consumption will not be permitted on the premises. The project will be in full compliance with all State ABC regulations. Chairperson Fahey stated that she believed the Commission previously conditioned hours of sale to be from 6:00 am and end at 12:00 midnight. Senior Planner Meyer stated this would be researched. Rich Tate stated that Texaco would comply with a condition regarding hours of sales if this is the City's standard procedure. Commissioner Slaven expressed concern that this item has come before the Commission for a second time and requested that the applicant demonstrate the finding for convenience since several locations exist along this route that sell beer and wine. Rich Tate responded that he did not know the proximity of other beer and wine sale locations. Commissioner Soltysiak recommended a more detailed policy be developed on Convenience or Necessity findings for future use by the Commission, He recommended this project permit no sales of alcohol between 12:00 midnight. and 6:00 a.m. Assistant Attorney Greg Diaz responded the Commission could condition the hours of sale at this meeting if the applicant agreed. Commissioner Miller stated that since a finding for convenience was approved for the Union and Shell Stations, and does see any logical bases for not making the same finding in the Texaco case. Chairperson Fahey agreed but recommended a policy be developed for consistency. Commissioner Webster stated that a convenience finding was reasonable since this project included gas, a food mart, and other businesses which made it unique and created a one-stop shopping opportunity. Commissioner Slaven agreed this is unique but could not support a necessity finding. It was moved by Commissioner Webster and seconded by Commissioner Miller to approve the Beer and Wine License for PA96-0048 CUP for Texaco as a public convenience. The motion carried as follows: AYES: 3 COMMISSIONERS: Webster, Miller, Soltysiak NOES: 2 COMMISSIONERS: Slaven, Fahey ABSENT: 0 COMMISSIONERS: None PLANNING DIRECTOR'S REPORT Planning Manager Debbie Ubnoske reported that to date the fast track process has only affected larger projects. Staff will now start implementing the process with smaller projects and this process will come before the Commission for review. It was moved by Commissioner Slaven and seconded by Commissioner Miller to adjourn the meeting at 7:10 P.M. The next regular meeting of the Planning Commission is scheduled for May 5, 1996, 6:00 P.M., Rancho California Water District's Board Room, 42135 Winchester Road, Temecula, California.
