Parker, Director of Community Services DATE: May 2, 2011 SUBJECT: TCSD Proposed Rates and Charges for Fiscal Year 2011-2012. PREPARED BY: David Bilby, Senior Debt Analyst RECOMMENDATION: That the Community Services Commission receive and file this report regarding the proposed TCSD Rates and Charges for Fiscal Year 2011-2012. BACKGROUND: The Temecula Community Services District (TCSD) operates under the authority of Community Services District Law and provides residential street lighting, perimeter slope landscape maintenance, recycling and refuse collection, and emergency road maintenance services in the City of Temecula. The boundaries of the TCSD are the same as those of the City, and the City Council serves as the Board of Directors. Property owners only pay for the TCSD services that they actually receive through separate rates and charges on their property tax bill. The Community Services, Parks and Recreation and Service Level A Rates and Charges previously levied by the TCSD were replaced by the City's Parks and Lighting Special Tax, approved by the voters as Measure C on March 4, 1997. However, pursuant to a cooperative agreement with the City, the TCSD continues to operate and maintain the City's recreational and cultural facilities and programs. The levy budget for the special tax will be considered by the City Council on June 14, 2011. As a result, the current services provided by the TCSD are divided into the following four (4) service levels: , 1. Service Level B- Residential Street Liqhtinq. Operations, maintenance, utility costs and administration of residential street lighting. 2. Service Level C- Perimeter Landscapinq and Slope Maintenance. Operations, maintenance, utility costs, improvements, and administration for all perimeter slope landscape maintenance areas maintained by the TCSD. 3. Service Level D— Recvclinq and Refuse Collection. Operation and administration of the recycling programs and refuse collection for single family residences. 4. Service Level R- Streets and Roads. Operations, reconstruction, and maintenance of unpaved streets and roads in a designated area of the City. Service Level "B" includes only those properties within residential subdivisions that have street lighting services. The proposed rate of $25.68 has not been increased from last fiscal year. Service Level "C" includes only those properties within residential zones where TCSD provides perimeter slope landscape maintenance services. Most of the zone rate levels were established in previous years and have not increased since last fiscal year. On March 4, 2008 a property owner election was held for twenty-nine (29) zones in Service Level C. The election proposed to assess an appropriate fee to cover the costs associated with landscape maintenance for each specific zone. Only one (1) zone successfully passed this election which was Woodcrest Country—Zone 6. The level of maintenance provided in each zone will be commensurate with the amount of revenue received for each zone. Note: The CPI change from December 2009 to December 2010 was 1.3%. Zone 6— Woodcrest Country rate is subject to the annual CPI inflator which will increase the rate from $96.84 to $98.06. Zone 29 - Gallery Homes "Portraits" rate is subject to the annual CPI inflator which will increase the rate from $345.54 to $350.00. Zone 31 was established to be used within the Roripaugh Ranch Development however due to construction delays the landscaping will not be accepted by the TCSD and this rate and charge will not be assessed for FY 2011-2012. However, this rate is subject to a CPI inflator and will increase from $28.50 to $28.88. Zone 32 was established to be used for the Vinyard View Estates. Vinyard View Estates is located on the northwest corner of Butterfield Stage Road and Chemin Clinet adjacent to Chardonnay Hills. Due to the economy this 37 lot development is being delayed and will not be assessed by the TCSD for FY 2011-2012. However, this rate is subject to a CPI inflator and will increase from $652.36 to $660.64. Service Level "D" provides recycling and refuse collection services to single family residential properties in the City of Temecula. For Fiscal Year 2011-2012, the rate and charge is proposed to increase from $220.66 to $223.76. This $3.10 increase is due to a CPI increase of 1.2% and a Diesel Fuel Component Index (DFCI) increase of 26.39%. Per our Franchise Agreement the CPI, DFCI, and land-fill tipping fee increases may cause our Service Level D rate and charge to change. Service Level "R" includes,only those properties that receive benefit of emergency maintenance of certain unpaved roads after inclement weather. The area covered by Service Level R is located in on and around Liefer Road in the northeastern area of the City. The maximum rate that can be charged for Service Level R for an improved parcel is $115.26, and for an unimproved parcel is $57.62. In Fiscal Year 2010-2011 parcels were charged the full rate to offset the costs of the emergency road maintenance services. For Fiscal Year 2011-2012 parcels in Service Level R are proposed to be charged the full rate. The levy and collection of the TCSD Rates and Charges is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 21080 (b)(8) of the California Public Resources Code and Section 15273 of the State Guidelines because the rates and charges are necessary to maintain existing services within the TCSD. BACKGROUND: On an annual basis, the TCSD presents the proposed CIP projects to the Community Services Commission for their review and approval. Below is a list of the CIP projects with construction funding or design funding for FY2011-2012. Staff is recommending that the Community Services Commission approve the following projects that are tentatively identified for funding in FY2011-2012. They include: • Library Parking Lot Expansion • Margarita Road Right of Way Enhancements • Old Town Gymnasium — Phase 1 • Old Town Public Art Project New Project • Children's Museum Enhancement Project • Flood Control Channel Re-Construction and Repair Project New Project • Gardner Middle School Tennis Court Resurfacing New Project • Great Oak High School Tennis Court Lighting New Project • Chaparral High School Tennis Court Lighting New Project • Inclusive Play Structure at Patricia H. Birdsall Sports Park ' New Project • Park Rehabilitation and Improvement Project New Project • Ronald Reagan Monument Site Preparation • Ronald Regan Sports Fark Channel Silt Removal Project • Mary Phillips Senior Center Outdoor Fitness Lot • Water Slide Replacement at CRC Pool The funding for these projects comes from a variety of different sources including Park Development Impact Fees, Quimby Fees and Community Development Block Grant Funding.
