BACKGROUND: At the meeting of December 10, 2009, the Public/Traffic Safety Commission received a presentation from the Temecula Police Department regarding their enforcement and data collection efforts on Seraphina Road. Subsequently, the Commission directed staff to schedule a neighborhood meeting with the residents of Seraphina Road and affected properties to develop traffic calming alternatives and to bring this item back to the Commission for further discussion. The public has been notified of the Public/Traffic Safety Commission's consideration of this issue through the agenda notification process and by mail. i In January 2010, Staff conducted an informal neighborhood meeting with residents of Seraphina Road and adjacent streets. The goal of the meeting was to discuss and understand resident concerns, receive traffic calming suggestions that could potentially be used to develop traffic calming alternatives, and present two (2) traffic calming alternatives being considered by Staff that could potentially address the resident's concerns for vehicular speeds and passing on Seraphina Road. The majority of the residents in attendance reside on Seraphina Road. The top three (3) concerns expressed by the residents are as follows: • Cut - through traffic volumes • Speeding • Unsafe passing of slower moving vehicles Other concerns expressed were: • Increase in the crime rate due to increased traffic volumes • Increase in vandalism due to increased traffic volumes • Pedestrian safety crossing Seraphina Road at Eastgate Parkway After identifying the resident's concerns, a discussion ensued about potential mitigation measures. The suggested mitigation measures are as follows: • Install barricades on Seraphina Road north of Andrews Way • Close and /or gate Seraphina Road at Jons Place • Provide a median closure on Murrieta Hot Springs Road to divert traffic from Seraphina Road onto North General Kearny Road • Restrict turn movements on Willows Avenue to divert traffic from Seraphina Road onto North General Kearny Road • Install Multi -Way Stop control and pedestrian crossing at the intersection of Seraphina Road and Eastgate Parkway • Open existing road closures in Meadowview, Starling Street and Sanderling Way • Install "fine" signs, similar to those on North General Kearny Road, with existing speed limit signs • Install speed limit signs on Rita Way • Replace existing 25 MPH speed limit sign with larger sign • Install electronic radar feedback speed limit display sign • Construct the Butterfield Stage Road Improvements As previously stated, the residents stated that their top three traffic concerns were: cut - through traffic, speeding, and unsafe passing. The residents attributed these conditions to a lack of available alternative routes, such as Butterfield Stage Road, to provide circulation in the area. Cut - Through Traffic In October 2009, the Temecula Police Department performed an extensive effort of enforcing the posted speed limit and collecting statistical data for a one month period. Included in the statistical data collection was a two (2) day license plate survey. The results of the enforcement and data collection effort were presented to the Commission at their meeting of December 10, 2009. 2 Based on the results of the license plate survey, approximately fifty -four percent (54 %) of the vehicles on Seraphina Road are generated from areas north of Murrieta Hot Springs Road (French Valley), thirty -two percent (32 %) of the vehicles are generated from areas southeast of Nicolas Road (Rancho California Road), four percent (4 %) of the vehicles are generated from areas northwest of Murrieta Hot Springs Road and Willows Avenue, one percent (1 %) of the vehicles are generated from areas west of Willows Avenue, and nine percent (9 %) of the vehicles are generated from within the immediate neighborhood bounded by Willows Avenue, Murrieta Hot Springs Road and Rita Way. This data confirms the residents' observations that the majority of vehicles on Seraphina Road are "pass- through" vehicles. The percentage data is shown in Exhibit "B ". Some of the potential solutions suggested by the residents to eliminate cut - through traffic included closing a median opening on Murrieta Hot Springs Road, restricting access on Willows Avenue to divert traffic away from Seraphina Road, and closing Seraphina Road to through traffic. Currently, vehicles traveling to and from points north of Murrieta Hot Springs Road (French Valley area) can access Seraphina Road from the Murrieta Hot Springs Road at Chandler Drive intersection, which is a full access intersection. The suggested median closure to eliminate left -tum movements into Chandler Drive would reduce the vehicles using this intersection by half. However, it is likely that the vehicles not able to turn left at this intersection will continue to Willows Avenue and access Seraphina Road via Evan Drive or Northgate Parkway. The suggested closure will not eliminate cut - through traffic on Seraphina Road, but could potentially increase vehicular volumes and speeds on Evan Drive and Northgate Parkway. Along with the median closure, a companion solution suggested by the residents is to restrict access along Willows Avenue and divert cut - through traffic to other streets including Goldenrod Road and North General Kearny Road. In the past, the Commission considered numerous requests from the residents of North General Kearny Road for traffic calming measures to address similar issues with cut through vehicular volumes and speeds. Eventually, a combination of traffic calming measures including speed limit signs, speed limit "fine" signs and multi -way stop controls at Goldenrod Road were implemented on North General Kearny Road, to mitigate some of the impacts caused by vehicular speeds and volumes. An introduction of diverted vehicular volumes from Seraphina Road would significantly impact this neighborhood and it is likely that those impacts would lead to requests from the North General Kearny Road residents for consideration of additional traffic calming measures to mitigate the new impacts. In addition to the impacts to North General Kearny Road residents, the potential access restriction along Willows Avenue will affect roadways and residents that are not in the City of Temecula but fall within the County of Riverside's jurisdiction. Any changes to access along Willows Avenue would require the County's formal approval. Our discussion with County staff indicates that restrictions along Willows Avenue impact traffic circulation in an area that already suffers from limited circulation alternatives. Moreover, County staff shared reluctance to support any restrictions without a comprehensive regional traffic circulation analysis. The County has no plans to conduct this level of analysis. Staff recommends denial of the request for access restrictions on Murrieta Hot Springs Road and Willows Avenue. Another solution suggested, by the residents, to eliminate cut through traffic was the closure of Seraphina Road at Jons Place. While the suggested closure at Jons Place potentially eliminates some cut through traffic on Seraphina Road, the traffic diverts to adjacent neighborhood streets such as Southgate Way, Parkview Drive, Eastgate Parkway, and Northgate Parkway, thereby shifting the problem elsewhere. 3 As the Seraphina Road residents aptly stated, "cut through traffic problems can be attributed to lack of alternate circulation routes ". A closure of Seraphina Road to through traffic compounds this problem by reducing the availability of residential collector roadway system. Past experience has shown that closing roads impacts adjacent roadways, often resulting in increased vehicular volumes and speeds. When this increase occurs on a residential roadway, the quality of life significantly impacts a larger area. Moreover, as with speed bumps, the City Council no longer considers roadway closures viable neighborhood traffic calming solutions. To that end, Staff cannot support the closure of Seraphina Road. Staff recommends denial of the request for the closure of Seraphina Road at Jons Place. The City's Capital Improvement Program includes improvements to Butterfield Stage Road from Murrieta Hot Springs Road to La Serena Road and Murrieta Hot Springs Road from Pourroy Road to Butterfield Stage Road. The proposed improvements within the City limits will include four (4) travel lanes, curb and gutter, sidewalks, drainage facilities, street lighting and traffic signal improvements. The design of the improvement plans is in the final stages and the City is in the process of acquiring the necessary right -of -way to construct the roadway improvements. Construction is anticipated in fall of 2010 for Phase 1 of the project, which includes Murrieta Hot Springs Road from Pourroy Road to Butterfield Stage Road and Butterfield Stage Road from Murrieta Hot Springs Road to Calle Chapos. This phase includes the connection of Calle Chapos between Walcott Avenue and Butterfield Stage Road. Phase 2 of the project, which will complete the reach on Butterfield Stage Road between Calle Chapos and La Serena Way, is scheduled to begin 12 months later. When completed, Butterfield Stage Road will provide a much needed north/south connection on the easterly side of the City. It is likely that the majority of the traffic currently using Seraphina Road as a pass through route will use Butterfield Stage Road to access destinations north and south of Temecula, which will provide some relief to the residents of Seraphina Road. Speeding and Unsafe Passing As the Commission is aware speeding in residential areas is a common problem on nearly every roadway in the City. The City's Neighborhood Traffic Calming Program was established to address concerns in a two (2) stage process which includes Stage 1, Education and Enforcement followed by Stage 2, Roadway Features. To date, Stage 1 traffic calming measures have been implemented on Seraphina Road with limited success in reducing vehicular speeds and volumes. As discussed at the Public/Traffic Safety Commission meeting of December 10, 2009, staff developed two (2) traffic calming alternatives, available in Stage 2 of the City's Neighborhood Traffic Calming Program toolbox, which may reduce vehicular speeds and provide some relief for the residents. Since both of the proposed alternatives could potentially impact Seraphina Road residents, it was necessary to receive the resident's majority acceptance of one (1) of the alternatives. The Stage 2 traffic calming alternatives presented to residents for consideration are described below and shown in Exhibit "D" — "F ". Alternative f — Raised Median Entry Treatment Raised Median Entry Treatments are considered less intrusive than chokers or raised medians and can provide identity to a neighborhood. An entry treatment along with striping can also be used as an effective means of reducing vehicular speeds on a roadway. The proposed entry 4 treatment is designed to narrow the travel way at strategic locations along Seraphina Road and give a clear message to drivers that they are now entering an area where speeds need to be controlled and to expect pedestrian activity. Under this alternative the raised median entry treatments will be located on Seraphina Road at Jons Place, Eastgate Parkway, and Andrews Way. In order for this alternative to be effective, the travel lanes will be shifted to the west (non residential side) to create a 12 foot wide travel lane in each direction, a continuous 6 foot wide median, and an 8 foot wide striped parking lane on the east side (residential side)of Seraphina Road, Alternative 2 — Raised Median Treatment A Raised Median Treatment is a more intrusive form of a neighborhood traffic calming feature that is very effective at reducing vehicular speeds on a roadway. The proposed raised median treatment would physically narrow the travel way from Sonia Lane to Rita Way, effectively eliminating left -turn access for the residents. This alternative also shifts the travel lanes to the west (non residential side) to create a 12 foot wide travel lane in each direction, a continuous 6 foot wide raised median, and an 8 foot wide striped parking lane on the east side (residential side)of Seraphina Road. After a brief discussion of the pros and cons under each of the alternatives, the residents (in attendance) were all in favor of implementing Alternative 1, Raised Median Entry Treatment. It was understood that the implementation of any of the two alternatives is not likely to reduce vehicular volumes, but will significantly reduce vehicular speeds and unsafe passing on Seraphina Road. Staff recommends the installation of interim striping, which simulates the Raised Median Entry Treatment concept. With the Commissions direction Staff will propose the raised median improvements in the City's Capital Improvement Program for future construction. Over the past few years, Staff has been diligently working with FORTEL the "VCalm" Speed Limit Sign manufacturer to try and procure a lightweight solar powered sign that can be mounted on a lightweight aluminum fifteen (15) foot pole. Recently, Staff met with representatives from FORTEL and were successful in "trading -in" the old "VCalm" signs fortwo (2) newer lightweight solar powered signs. Since both the sign and pole are lightweight, the installation can be rotated to different locations that are experiencing increased vehicular speeds. Staff recommends the installation of "VCalm Signs on a rotation basis for monitoring and reducing vehicular speeds on Seraphina Road. In the past, the Commission has recommended the installation of placards below the speed limit sign that indicates the "fine" for violation of the posted speed limit. This along with enhancing the visibility of the speed limit sign by increasing the size of the sign has been effective at maintaining reasonable vehicular speeds on North General Kearny Road. Another tool that has been very effective at reducing vehicular speeds and advising motorist of a change in conditions is the speed reduction regulatory sign. We believe that posting a speed reduction sign on Rita Way compliments the installation of the increased speed limit signs and "fine" placards. Staff recommends the installation of the speed reduction sign on Rita Way, installation of "fine" placards, and increasing the size of the speed limit signs on Seraphina Road. 5 The residents also requested the installation of multi -way stop signs at the intersection of Seraphina Road and Eastgate Parkway to mitigate vehicular speeds and provide for a controlled pedestrian crossing on Seraphina Road. Staff collected pedestrian and count data over a two (2) day period in February to determine if multi -way stop signs are warranted using the Multi -Way Stop Sign Installation Policy for Residential Streets. The results of the data collection and warrant analysis revealed that current conditions do not justify multi -way stop signs at the intersection. Staff recommends denial of the request for multi -way stop signs at the intersection of Seraphina Road and Eastgate Parkway. Lastly, Seraphina Development is proposing to construct eighty (80) single family residential units on the vacant property located at the corner of Joseph Road, Rita Way and Nicolas Road. Staff has had lengthy discussions with the developer about the neighborhood's concerns with traffic circulation in the area and at the proposed site. As a result, Seraphina Development has agreed to design and construct a reduced roadway section on Rita Way to compliment the proposed traffic calming measures on Seraphina Road and promote reduced vehicular speeds. The proposed Rita Way roadway improvements will include a Raised Median Entry Treatment and striping. Since, the project will have an access point at the intersection of Rita Way and Seraphina Road, the developer has agreed to install multi -way stop signs to assign right -of -way at this intersection. In the interim, staff will implement striping improvements on Rita Way to produce a narrowing of the existing roadway section. Staff recommends the installation of interim striping to reduce the existing roadway section until development of Tract 32346 occurs and roadway improvements are implemented on Rita Way. While the recommended traffic calming measure may not reduce vehicular volumes significantly, it is Staffs opinion that they will provide some relief to the residents by reducing vehicular speeds and passing on Seraphina Road. Relief from cut through vehicular volumes cannot occur until alternate circulation routes are completed in the area. FISCAL IMPACT: Funds are available for the installation of signs, striping and associated pavement markings in the Public Works Routine Street Maintenance Account. Attachment 1. BACKGROUND: Council Member Mary Ann Edwards requested that the City Attorney's Office review the Temecula Municipal Code Section 2.56 to ensure the City's Disaster Relief Ordinance is in compliance with existing state and federal laws. The City's Disaster Relief Ordinance was adopted in 1991 and in order to ensure it captures the most recent changes in State and Federal laws, the City Attorney's Office has recommended that the Ordinance be modified as follows: 1. Temecula Municipal Code Section 2.56.150.A.4. is recommended to be amended to limit the authority of the City Manager to confiscate firearms during a declared emergency. This change will bring the Temecula Municipal Code in compliance with California Government Code Section 8571.5 (amended in 2008) and Federal Statue 42 USC Section 5207 enacted in 2006 which prohibits the confiscation of firearms in an emergency. 2. Temecula Municipal Code Section 2.56.050.A.(1) is recommended to be revised to be in compliance with AB 486 (Government Code Section 8630) to require the City Council to review the need for continuing the local emergency once every 30 days rather than once every 14 days. FISCAL IMPACT: No fiscal impact associated with these recommended modifications. Attachment Revised City Disaster Ordinance i DRAFT: JANUARY 25, 2010 ORDINANCE NO. 10- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING CHAPTER 2.56 OF THE TEMECULA MUNICIPAL CODE RELATING TO EMERGENCY ORGANIZATION AND FUNCTIONS THE CITY COUNCIL OF THE CITY OF TEMECULA DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Temecula hereby amends Chapter 2.56 of the Temecula Municipal Code to read as follows: "Chapter 2.56 Emergency Organization and Functions 2.56.010 PURPOSES The declared purposes of this Chapter are to provide for the preparation and carrying out of plans for the protection of persons and property within this city in the event of an emergency; the direction of the emergency organization; and the coordination of the emergency functions of this city with all other public agencies, corporations, organizations, and affected private persons. 2.56.020 DEFINITION A. As used in this chapter, "emergency" shall mean the actual or threatened existence of conditions of disaster or of extreme peril to the safety of persons and property within this city caused by such conditions as air pollution, fire, flood, storm, epidemic, riot, or earthquake, or other conditions, including conditions resulting from war or imminent threat of war, but other than conditions resulting from a labor controversy, which conditions are or are likely to be beyond the control of the services, personnel, equipment, and facilities for this city, requiring the combined forces of other political subdivisions to combat. B. Other terms used in this chapter shall have meanings as used in the California Emergency Services Act. 2.56.030 DEVELOPMENT OF EMERGENCY AND MUTUAL AID PLANS AND BIPLEMENTING REGULATIONS It shall be the duty of the City Manager, and he or she is hereby empowered, to develop and recommend for adoption by the city council, the city's emergency plan, mutual aid plans and agreements and such ordinances and resolutions and rules and regulations as are necessary to implement such plans and agreements. The city's emergency plan shall provide for the effective mobilization of all of the resources of this city, both public and private, to meet any condition constituting a local emergency, state of emergency, or state of war emergency; and shall provide for the organization, powers and duties, services, 4- 11086-0001U201639vl DRAFT: JANUARY 25, 2010 and staff of the emergency organization. Such plan shall take effect upon adoption by resolution of the city council. 2.56.040 DIRECTOR AND ASSISTANT DIRECTOR OF EMERGENCY SERVICES A. There is hereby created the office of director of emergency services ( "director"). The city manager shall be the director of emergency services. B. There is hereby created the office of assistant director of emergency Services ( "assistant director"), who shall be appointed by the director. 2.56.050 POWERS AND DUTIES OF THE DIRECTOR OF EMERGENCY SERVICES A. Subject to applicable state and federal laws, the director is hereby empowered to: (1) Request the city council to proclaim the existence or threatened existence of a "local emergency" if the city council is in session, or to issue such proclamation if the city council is not in session. Whenever a local emergency is proclaimed by the director, the city council shall take action to ratify the proclamation within seven (7) calendar days thereafter or the proclamation shall have no further force or effect. The city council shall review the local emergency proclamation at least every fourteen days, or such other period as required by law, and shall terminate the emergency proclamation at the earliest possible date the conditions warrant. (2) Request the Governor to proclaim a "state of emergency" when, in the opinion of the director, the locally available resources are inadequate to cope with the emergency. (3) Control and direct the effort of the city's emergency organization for the accomplishment of the purposes of this chapter. (4) Direct cooperation between and coordination of services and staff of the city's emergency organization; and resolve questions of authority and responsibility that may arise between them. (5) Represent this city in all dealings with public or private agencies on matters pertaining to emergencies as defined herein. (6) In the event of the proclamation of a "local emergency" as herein provided, the proclamation of a "state of emergency" by the Governor or the Secretary of California Emergency Management, or the existence of a "state of war emergency," the director is hereby empowered: (a) To make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such 11086. 0001 \1201639vl DRAFT: JANUARY 25, 2010 emergency; provided, however, such rules and regulations must be confirmed at the earliest practicable time by the city council; (b) To obtain vital supplies, equipment, and such other properties found lacking and needed for the protection of life and property and to bind the city for the fair value thereof and, if required immediately, to commandeer the same for public use; (c) To require emergency services of any city officer or employee and, in the event of the proclamation of a "state of emergency" in the county in which this city is located or the existence of a "state of war emergency," to command the aid of as many citizens of this community as deemed necessary in the execution of duties; such persons shall be entitled to all privileges, benefits, and immunities as are provided by state law for registered disaster services workers; (d) To requisition necessary personnel or material of the city's departments or agencies; and (e) To execute all ordinary power as city manager, all of the special powers conferred by this chapter or by resolution or emergency plan pursuant hereto adopted by the city council, all powers conferred by any statute, by any agreement approved by the city council, and by any other lawful authority. B. The director shall designate the order of succession to that office, to take effect in the event the director is unavailable to attend meetings and otherwise perform duties during an emergency. Such order of succession shall be approved by the city council. C. The assistant director shall, under the supervision of the director and with the assistance of emergency service chiefs, develop emergency plans and manage the emergency programs of this city; and shall have such other powers and duties as may be assigned by the director. 2.56.070 EMERGENCY ORGANIZATION All officers and employees of this city, together with those volunteer forces enrolled to aid them during an emergency, and all groups, organizations, and persons who may by agreement or operation of law, including persons impressed into service under the provisions 2.56.060A.(6)(c) of this chapter, be charged with duties incident to the protection of life and property in this city during such emergency, shall constitute the emergency organization of the city. 2.56.090 EXPENDITURES 3 11086 -0001 \1201639v1 DRAFT: JANUARY 25, 2010 Any expenditure made in connection with emergency activities, including mutual aid activities, shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property of the city. 2.56.100 PROHIBITED ACTS DURING EMERGENCIES A. It shall be a violation of this code for any person during an emergency, to: 1. Willfully obstruct, hinder, or delay any member of the emergency organization in the enforcement of any lawful rule or regulation or order issued pursuant to this ordinance, or in the performance of any duty imposed upon him by virtue of this ordinance. 2. Do any act forbidden by any lawful rule or regulation issued pursuant to this ordinance, if such act is of such a nature as to give or be likely to give assistance to the enemy or imperil the lives or property of inhabitants of this city, or to prevent, hinder, or delay the defense or protection thereof. 3. Wear, carry, or display, without authority, any means of identification specified by the emergency agency of the State. B. Any person violating any of the provisions of this chapter may be prosecuted pursuant to the enforcement provisions set forth in Title 1 of this code." Section 2. It is the intent of the City Council in enacting this Ordinance that it shall be a revision and continuation of Chapter 2.56, originally enacted by Ordinance No. 91 -34, and that the appointment and status of volunteers and such plans, agreements, rules, regulations and resolutions adopted pursuant to Chapter 2.56 shall continue in full force and effect by their terms, until such time as they may be amended, modified, superseded or repealed by actions pursuant to Chapter 2.56. Section 3. If any portion, provision, section, paragraph, sentence, or word of this Ordinance is rendered or declared to be invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining portions, provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect and shall be interpreted by the court so as to give effect to such remaining portions of the Ordinance. Section 3.
