Authorize the City Manager to take all other actions necessary and to execute such other documents as may be necessary to effectuate the requested reorganization though LAFCO BACKGROUND: The Redhawk Area will be annexed to the City of Temecula whether or not the proposed action is approved by the Riverside County Local Agency Formation Commission. The proposed action would simply move up the effective date of the annexation one day from July 1, 2005 to June 30, 2005. By moving the effective date by one day the City will retain approximately $512,000.00 per year in revenue which it had been projected to receive as part of the fiscal. analysis of the Redhawk Annexation. R/Agenda ReportsfTem RedhawkAnnexation (2) 033105 Under the complex Budget Act of 2004 and the "vehicle license fee swap" legislation, the calculation of the City's revenue changes radically if the annexation is effective in fiscal year 2004-5 as opposed to fiscal year 2005-6. According to LAFCO staff, this is the only method to accomplish the change in the effective date of the Redhawk Annexation. DISCUSSION On November 20, 2003, the Riverside County Local Agency Formation Commission ("LAFCO") approved the annexation of the Redhawk Area to the City of Temecula by Resolution No. 53-03 ("Redhawk Annexation"). A Certificate of Completion for the Redhawk Annexation was filed by LAFCO on January 23, 2004 and the Redhawk Annexation will be effective on July 1, 2005. Approval of the Redhawk Annexation on November 20, 2003 was preceded by the preparation of extensive financial studies of the revenues and expenditures necessary to provide the high level of municipal service to the Redhawk Annexation Area as are provided to the other areas of the City of Temecula. On March 2, 2004, the voters in the Redhawk Area overwhelmingly approved the Redhawk Annexation with 93.86 % voting in favor. The voters also overwhelmingly approved the City parcel tax to be used for parks, recreational facilities, recreational and community services programs, median landscaping, and arterial streetlights and traffic signals with 93.12 % voting in favor. The voters also overwhelmingly approved the Temecula Community Services District's rates and charges to be levied against parcels in the Redhawk Area for residential street lighting and slope maintenance with 92.62% voting in favor. With the voters' approval of the Redhawk Annexation and the voters' approval of the two tax measures, the Redhawk Annexation was projected to generate sufficient revenues to pay for the municipal services required for this area as projected in the fiscal analysis prepared for the annexation proceedings before LAFCO. Following the completion of the Redhawk Annexation and the two revenue measures, the Legislature enacted Chapter 211 of the Statutes of 2004 and Chapter 610 of the Statutes of 2004 amending Revenue and Taxation Code Section 97.70 which radically altered the in-lieu vehicle license fee adjustments and the complex formulas for distributing in-lieu vehicle license fee revenues to cities. The legislation specifies that assessed value of an area during its first year of annexation is to be ignored for purposes of calculating growth in the city's property tax in-lieu vehicle license fee distribution. The effect of this is to substantially reduce the added revenues that would come with an annexation depending on the extent of build-out of the area upon annexation. The more fully built out the area prior to annexation, the greater the revenue loss to the annexing city. This provision is inconsistent with the statutory plan for the equitable distribution of in-lieu vehicle license fee revenues to cities based on assessed valuations and improperly deprives cities of the revenues necessary to fulfill its obligations to provide municipal services to areas annexed to the city. This legislation reduces the in-lieu vehicle license fee revenues to the City of T emecula projected as part of the fiscal analysis of the Redhawk Annexation by $512,000.00 for the first year of the Redhawk Annexation and by a similar amount each year there after. The proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of Temecula and the Temecula Community Services District of the Redhawk Area would enable the City to retain the full amount of in-lieu vehicle license fees and fulfill the voters' intent that the Redhawk Annexation proceed on the basis of the R/Agenda ReportsfTem Redhawk Annexalion (2) 033105 2 providing municipal services to the Redhawk Area upon a sound fiscal basis. The proposed actions enable the City of Temecula to retain revenue to which it is entitled as part of the Redhawk Annexation. The proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of T emecula and the T emecula Community Services District of the Redhawk Area does nothing more than change the effective date of the Redhawk Annexation from July 1, 2005 to June 30, 2005 and thus avoids the inequitable and unintended harsh consequences of the legislation amending Section 97.70. The proposed action will have no fiscal impact on the County of Riverside nor on any other city in Riverside County because the additional $512,000.00 in-lieu vehicle license fee revenues which would come to the City of Temecula would be from State revenues under the 2004 Budget Act "vehicle license fee swap." If the proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of Temecula and the Temecula Community Services District of the Redhawk Area is not approved so as to make the effective date of the Redhawk Annexation June 30, 2005, the Redhawk Annexation will be effective on July 1, 2005, but the City will lose the projected $512,000.00 per year necessary to make the Redhawk Annexation financially viable. As part of the approval of the Redhawk Annexation in 2003, the City approved a Negative Declaration pursuant to the requirements of the California Environmental Quality Act. None of the factual situations described in Sections 15162, 15163 and 15164 of CEQA Guidelines (Title 14 of the California Code of Regulations) exist. These sections set forth various factual situations which would require preparation of subsequent environmental review documents. Therefore, the proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of T emecula and the T emecula Community Services District of the Redhawk Area is exempt from further environmental review. Quite simply, under the proposed action, the only change from the existing Redhawk Annexation is that the effective day will be moved up one day from July 1, 2005 to June 30, 2005. The effect of this change in the effective date affects City revenues but has no effect on the environment. All of the environmental effects of the Redhawk Annexation were analyzed in accordance with the requirements of the California Environmental Quality Act as part of the approval of the Redhawk Annexation in 2003 and there have been no changes in the project or the environment which would warrant further environmental review. Therefore, the environmental review for the proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of T emecula and the T emecula Community Services District of the Redhawk Area is exempt from further environmental review and complies with the requirements of the California Environmental Quality Act. FISCAL IMPACT: If the Reorganization is approved, the City will retain $512,000 per year in in-lieu vehicle license fee revenues as a result of the Redhawk Annexation. If the Reorganization is not approved or not completed, the City will lose $512,000 per year in in-lieu vehicle license fee revenue as a result of the Redhawk Annexation. OS-_ A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF TEMECULA REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE REORGANIZATION TO INCLUDE CONCURRENT DETACHMENTS FROM THE CITY OF TEMECULA AND THE TEMECULA COMMUNITY SERVICES DISTRICT AND CONCURRENT ANNEXATIONS TO THE CITY OF TEMECULA AND THE TEMECULA COMMUNITY SERVICES DISTRICT (REDHAWK AREA) THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City Council of the City of Temecula does hereby find, determine and declare that: a. The City of Temecula desires to initiate a proposal pursuant to the Cortese-Knox- Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code, for the concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of Temecula and the Temecula Community Services District of the Redhawk Area. b. Notice of the Intent to adopt this resolution of application has not been given to the Commission and each interested party and subject agency at least 20 days prior to the adoption of this Resolution. c. The territory proposed to be concurrently detached from the City of T emecula and the Temecula Community Services District and concurrent annexed to the City of Temecula and the Temecula Community Services District is inhabited, and a description of the boundaries of the territory is set forth in Exhibit A, attached hereto and by this reference incorporated herein ("Redhawk Area"). d. This proposal is consistent with the sphere of influence of the City of Temecula and the Temecula Community Services District. e. The Council desires to provide that the proposed concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City of Temecula and the Temecula Community Services District of the Redhawk Area be effective as of June 30, 2005. f. The Planning Director is authorized and directed to file a Notice of Exemption as provided by law. h. As described above, the voters in the Redhawk Area overwhelmingly approved the Redhawk Annexation, the City parcel tax, and the TCSD rates and charges. The proposed detachment and annexation only changes the effective date of the Redhawk Annexation and does not modify in any way the revenue measures approved by the voters. Section 2. The City Council of the City of Temecula hereby requests the Local Agency Formation Commission to take all proceedings necessary for the concurrent detachments from the City of Temecula and the Temecula Community Services District and concurrent annexations to the City ofTemecula and the Temecula Community Services District of the Redhawk Area, as described in Exhibit 1, according to the terms and conditions stated above and in the manner provided by the Cortese-Know-Hertzberg Local Government Reorganization Act of 2000.
