PA04-0388, A DEVELOPMENT PLAN (PRODUCT REVIEW) FOR 123 DETACHED SINGLE-FAMILY RESIDENTIAL HOMES LOCATED WITHIN PLANNING AREA 9 OF THE WOLF CREEK SPECIFIC PLAN, EAST OF PECHANGA PARKWAY AND NORTH OF WOLF VALLEY ROAD. UNITS RANGE FROM 2,646 SQUARE FEET TO 3,251 SQUARE FEET WITH 4 DIFFERENT FLOOR PLANS EACH WITH 3 ARCHITECTURAL DESIGNS (TRACT MAP 29798-9 AND 29798). ! , DH RESOLUTION NO. 2004-031 WHEREAS, the City Council of the City of Temecula adopted the Woif Creek Specific Plan on February 13, 2001 ; WHEREAS, Horton Continental Homes, filed Planning Application No. PA04-0388, in a manner in accord with the City of Temecula General Plan and Development Code; WHEREAS, Planning Application No. PA04-0388 was processed including, but not limited to a public notice, in the time and manner prescribed by State and local law; WHEREAS, the Planning Director, at a regular meeting, considered Planning Application No. PA04-0388 on October 21, 2004, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; WHEREAS, at the conclusion of the Planning Director Hearing and after due consideration of the testimony, the Planning Director approved Planning Application No. PA04- 0388 subject to the conditions after finding that the project proposed in Planning Application No. PA04-0388 conformed to the City of Temecula General Plan, Development Code and Wolf Creek Specific Plan; NOW, THEREFORE, THE PLANNING DIRECTOR OF THE CITY OF TEMECULA DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct and are hereby incorporated by reference. Section 2. FindinQs. The Planning Director, in approving Planning Application No. PA04-0388 (Development Plan) hereby makes the following findings as required by Section 17.05.010F of the Temecula Municipal Code: A. The proposed use is in conformance with the General Plan for Temecula and with all applicable requirements of state law and other ordinances of the city. The proposed single-family homes are permitted in the Medium Density land use designation standards contained in the Wolf Creek Specific Plan and the City's Development Code. The project is also consistent with the Medium land use designation contained in the General Plan. The site is properly planned and zoned, and as conditioned, is physically suitable for the type and density of residential development proposed. The project, as conditioned, is R,IPwduct ReviewlWolfCceeklO4-0388 Copper Moon PA9\FINAL RESO AND COA'S.doc I also consistent with other applicable requirements of State law and local ordinances, including the California Environmental Quality Act (CEQA), the City Wide Design Guidelines, and fire and building codes. B. The overall development of the land is designed for the protection of the public health, safety, and general welfare. The overall design of the single-family homes, including the site, building, parking, circulation and other associated site improvements, is consistent with, and intended to protect the health and safety of those working in and around the site. The project has been reviewed for, and as conditioned, has been found to be consistent with all applicable policies, guidelines, standards and regulations intended to ensure that the development will be 'constructed and function in a manner consistent with the public health, safety and welfare. I Section 3. Environmental Compliance. A Notice of Determination for Planning Application No. PA04-0388 was prepared per the California Environmental Quality Act Guidelines Section 15162. This section applies when an Environmental Impact Report (EIR) has been certified and there are no substantial changes not discussed or examined in the EIR. Section 4. Conditions. That the City of Temecula Planning Director hereby approves Planning Application No. PA04-0388, a Product Review for 123 detached single- family residential homes located within Planning Area 9 of the Woif Creek Specific Plan, ranging from 2,646 square feet to 3,251 square feet with four (4) different floor plans and three (3) architectural designs for each plan, subject to the conditions of approval set forth on Exhibit A, attached hereto, and incorporated herein by this reference together with any other conditions that may be deemed necessary. Section 5. PASSED, APPROVED AND ADOPTED by the City of Temecula Director of Planning this 2151 day of October 2004. Principal Planner David Hogan presiding. Also present were Associate Planner Cheryl Kitzerow, Associate Planner Stuart Fisk and Minute Cierk Kathy Simpkins Item No.1: Planninq Application No. PA04-0508 A Minor Conditional Use Permit for the sale of used automobiles from a 1.375 square foot showroom situated within an existinq multi-tenant commercial buiidinq. Associate Planner Stuart Fisk gave an overview of project and staff recommendations. There are no further changes and staff recommends approval. Principal Planner David Hogan opened Public Hearing at 1 :38PM. Applicant Russell Rumansoff, 530 St. John Place, Hemet CA, stated he had received the Conditions of Approval and was in agreement. Principal Planner Hogan asked for Suite B-1 to be included in the address on the project description. Clarification was also requested with condition 9 to state,"Outdoor storage of vehicles for sale, whether or not they are posted for sale, is strictly prohibited". Principal Planner Hogan questioned the hours of operation. It was agreed that condition 14 would be added making reference to the statement of operations. Mr. Rumansoff agreed to the addition and modification to above referenced conditions. No further requests to speak were presented. Principal Planner Hogan approved PA04-0508 Principal Planner Hogan closed the Public Hearing 1 :45 PM Item No.2; Planninq Application No. PA04-0388 A Product Review for 123 detached sinqle- familv residential homes located within Planninq Area 9 of the Wolf Creek Specific Plan. Units ranqe from 2,646 square feet to 3.274 square feet with 4 different floor plans and 3 architectural desiqns for each plan. Principal Planner Hogan opened this portion of the public hearing at 1 :48 PM Associate Planner Cheryl Kitzerow gave an overview of the project and staff recommendations. Staff is recommending that condition 17, include a requirement for additional enhancements to the A elevations for the Plan 2. Staff is recommending that the 2nd story shutters on the right side of the standard and enhanced elevations for this Plan 2 shall be replaced with decorative wrought iron. For the Plan 2, 3, and 4 A elevations Staff is recommending that the 2nd story principal window on the rear elevation have an arched window surround to maintain the architectural style of the Spanish elevation of the front enhancements. Enhanced elevations are proposed from street visible locations per the Wolf Creek Specific Plan. Staff has added condition 16 to clarify and ask for additional enhancements. The key on the product placement plan and the asterisks located on the plan are in conflict. Staff has determined that the project is in compliance with the Wolf Creek Specific Plan. The representative for the applicant D.R. Horton, Bridgett Miranda, 5927 Priestly Drive, Suite 200 Carlsbad, CA. has reviewed the conditions of approval and concurs with conditions and corrections as stated. No further requests to speak were presented. Principal Planner Hogan approved PA04-0388.
