805acresgenerallylocaednearthefutureintersectionsofNicholasRoadandButterfieldStageRoadandMurrietaHotSpringsRoadandButterfieldStageRoadgenerallyknownstheRoripaughRanchSpecificPlanNo11ProjectWHEREASthe PlanningCommissionheldadulynoticedpublichearingonFebruary12006andrecommendedhattheCityCouncilapprovetheattachedamendmenttotheRoripaughRanchDevelopmentAgreementWHEREASthisResolutioncomplieswithallthea ppliablerequirementsofStatelawandlocallawincludinglocalordinancesandtheCaliforniaEnvironmentalQualityActandWHEREASthePlanningCommisionataregularmeetingconsideredtheApplicationonFebruary12006toconside eementamendmentwouldfurthertheCityslongtermeconomicdevelopmentgoalsSection3EnvironmentalComolanceOnNovember262002theCityCounciladoptedResolutionNo02111certifyingtheEnvironmentalImpactReportfortheRori paughRanchSpecificPlaandRelatedPlanningApplicationsincludingtheDevelopmentAgreementEIRThePlanningCommissionfindsbasedontheadministrativerecordthatthEIRproperlyaddressedalloftheenvironmentalissuesenco mpassedwithintheFirstAmendmenttotheDevelopmentAgreementandthat1therehavebeenosubstantialchangesintheProjectwhichrequiremajorrevisionsoftheEIRduetotheinvolvementofnewsignificantenvironmentaleffectsora subsantialincreaseintheseverityofpreviouslyidentifiedsignificanteffects2nosubstantialchangeshaveoccurredwithrespecttothecircumstancsunderwhichtheProjecthasbeenundertakenwhichrequiremajorrevisionsofth eEIHduetotheinvolvementofnewsignificantenvironmentaleffectsrasubstantialincreaseintheseverityofpreviouslyidentifiedsignificanteffectsand3nonewinformationofsubstantialimportanceexistswhicwasnotknoworc ouldnothavebeenknownwiththeexerciseofreasonablediligenceatthetimeofthecertificationoftheEIRwhichshowstheProjectwoudhaveoneormoresignificanteffectsoramoreseveresignificantimpactnotdiscussedintheEIRort hatmitigationmeasuresoralternativesnotfounfeasiblewouldinfactbefeasibleorthatothermitigationmeasuresoralternativeswouldsubstantiallyreduceoneormoreofthesignificanteffectThereforeneitherasubsequentnor asupplementalEIRisrequiredandthePlanningCommissionrecammendsthataNoticeofDeterminationDeterminatinofConsistencyforwhichanEnvironmentalImpactReportwaspreviouslyadoptedSec15162SubsequentEIRsandNegative
