Staff has worked with the applicant to ensure that all concerns have been addressed, and the applicant concurs with the recommended Conditions of Approval. ANALYSIS Planning Application No. PA24-0218 is a request for a Conditional Use Permit by Nicole Ballow to operate a batting cage training facility to offer both baseball and softball practice, private lessons, camps, clinics, and youth instructional training in an existing building located at 42637 Avenida Alvarado. The proposed facility will function inside an approximately 19,769 square foot existing building that consists of warehouse and office space. Batting cages are classified as a sports and recreational use. Zoning for the existing building is Light Industrial. Temecula Development Code Section 17.08.030 permits sports and recreational facilities in the Light Industrial zone with a Conditional Use Permit. The proposed Conditional Use Permit will not add square footage or exterior modifications to the existing building. The extent of the applicant's modifications is within the building and are comprised of addition of a seating area and 10 batting cages. The building is a new construction that should meet the current Accessible Disabilities Act (ADA) requirements. The proposed Conditional Use Permit would permit the owner to operate Monday through Friday from 11:00 a.m. to 9:00 p.m., Saturday from 11:00 a.m. to 7:00 p.m. and Sunday from 11:00 a.m. to 6:00 p.m. Per Table 17.24.040 of the Temecula Development Code, 23 parking spaces are required for all the proposed uses (batting cages and office) operating within the building. There are currently 25 parking spaces on -site for the building. LEGAL NOTICING REQUIREMENTS Notice of the public hearing was published in The Press -Enterprise on June 26, 2025, and mailed to the property owners within the required 600-foot radius. 2 ENVIRONMENTAL DETERMINATION In accordance with the California Environmental Quality Act, the proposed project has been deemed to be categorically exempt from further environmental review (Section 15301, Class 1, Existing Facilities). The request for a Conditional Use Permit is for a batting cage training facility to offer both baseball and softball practice, private lessons, camps, clinics, and youth instructional training within an existing building with no expansion being proposed. Sports and recreational facilities are conditionally permitted uses at the project site. As such, this project represents no expansion of the structure, site, or allowable uses. FINDINGS Conditional Use Permits (17.04.010 E) The proposed conditional use is consistent with the General Plan and the Development Code. The business will operate a batting cage training facility to offer both baseball and softball practice, private lessons, camps, clinics, and youth instructional training. This proposed use is consistent with the City of Temecula General Plan and Development Code, which identifies the project site as Light Industrial (LI). The General Plan and Development Code allows for sports and recreational facility at the project site upon the approval of a Conditional Use Permit. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures. The conditional use will be located within an existing structure within a Light Industrial (LI) zone. As stated, the proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings, and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures because the surrounding area are for industrial uses, and the building can accommodate the use. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in this development code and required by the planning commission or council in order to integrate the use with other uses in the neighborhood. The application will allow a batting cage training facility to offer both baseball and softball practice, private lessons, camps, clinics, and youth instructional training within an existing building. No modifications to the site are proposed. Since the site and proposed conditional use are consistent with the General Plan and Development Code requirements, the project site is adequate to accommodate the proposed use as required by the Director of Community Development in order to integrate the use with other uses in the neighborhood. 3 The nature of the proposed conditional use is not detrimental to the health, safety and general welfare of the community. The use, as conditioned, meets all requirements of the Development, Fire, and Building Codes. These codes contain provisions designed to ensure the protection of the health, safety, and general welfare of the community. Crime Prevention Through Design. Crime prevention through environmental design, as developed by the National Crime Prevention Institute (NCPI), supports the concept that "the proper design and effective use of the built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life." The nine primary strategies that support this concept are included below: 1. Provide clear border definition of controlled space. Examples of border definition may include fences, shrubbery, or signs in exterior areas. Within a building, the arrangement of furniture and color definition can serve as a means of identifying controlled space. 2. Provide clearly marked transitional zones. Persons need to be able to identify when they are moving from public to semi-public to private space. 3. Gathering or congregating areas to be located or designated in locations where there is good surveillance and access control. 4. Place safe activities in unsafe locations. Safe activities attract normal users to a location and subsequently render the location less attractive to abnormal users due to observation and possible intervention. 5. Place unsafe activities in safe locations. Placing unsafe activities in areas of natural surveillance or controlled access will help overcome risk and make the users of the areas feel safer. 6. Redesign the use of space to provide natural barriers. Separate activities that may conflict with each other (outdoor basketball court and children's play area, for example) by distance, natural terrain or other functions to avoid such conflict. 7. Improve scheduling of space. The timing in the use of space can reduce the risk for normal users and cause abnormal users to be of greater risk of surveillance and intervention. 8. Redesign space to increase the perception of natural surveillance. Abnormal users need to be aware of the risk of detection and possible intervention. Windows and clear lines -of -sight serve to provide such a perception of surveillance. 9. Overcome distance and isolation. This strategy may be accomplished through improved communications (portable two-way radios, for example) and design efficiencies, such as the location of restrooms in a public building. 38. Business Security Survey. The CORE Team of the Temecula Sheriff's Station offers free business security surveys, to schedule an appointment contact the unit at (951) 506-5130. 39. Contact. Any questions regarding these conditions should be directed to the CORE Team of the Temecula Sheriff's Station at (951) 506-5130.
